+Nos, JUSTO JOSE DE URQUIZA Presidente de la Confederacion
+Argentina--Hacemos saber á todos los que el presente instrumento de
+confirmacion vieren que á los 29 dias del mes de Julio del presente año
+se concluyó y firmó en la Ciudad de la Asuncion entre la Confederacion
+Argentina y la República del Paraguay, debidamente representadas, un
+Tratado de amistad, comercio y navegacion, cuyo tenor y forma es como
+sigue:
+
+EN EL NOMBRE
+
+de la
+
+SANTISIMA TRINIDAD.
+
+Deseando el Gobierno de la Confederacion Arjentina y el de la República
+del Paraguay estrechar, íntima y sinceramente las buenas relaciones tan
+necesarias para el desarrollo y progreso de una y otra nacion, sobre las
+justas bases de comun interés; y de una reciprocidad perfecta, por un
+tratado de amistad, comercio y navegacion: S. E. el Sr. Presidente de la
+Confederacion Arjentina ha nombrado por su Enviado Extraordinario y
+Ministro Plenipotenciario al ciudadano Arjentino, Jeneral y Senador, D.
+Tomas Guido; y S. E. el Sr. Presidente de la República del Paraguay por
+su Plenipotenciario, al ciudadano paraguayo Nicolas Vazquez, Ministro
+Secretario de Estado de Relaciones Exteriores.
+
+Los cuales despues de haber examinado y canjeado sus respectivos Plenos
+Poderes y hallándolos en buena y debida forma, han ajustado y concluido
+los artículos siguientes:
+
+ARTICULO I.
+
+Habrá perfecta paz y sincera amistad entre la Confederacion Arjentina y
+la República del Paraguay. Los respectivos Gobiernos se comprometen
+mùtuamente á emplear toda eficacia en consolidarlos perpetuamente.
+
+ARTICULO II.
+
+La Confederacion Arjentina y la República del Paraguay adoptan por base
+de sus mútuas relaciones, la mas extrícia y franca reciprocidad.
+
+ARTICULO III.
+
+Si aconteciere que una de las Altas Partes Contratantes se hallase en
+guerra con una tercera Potencia, la otra Parte Contratante se conservará
+perfectamente neutra.
+
+ARTICULO IV.
+
+En el caso establecido del anterior artículo 3.º, los ciudadanos de la
+Potencia que se corservare neutra, podrán continuar su comercio y
+navegacion con el Estado en guerra, exceptuados los puertos y ciudades
+que se hallen bloqueados ó sitiados por agua, ó tierra: empero en ningun
+caso será permitido el comercio de artículos reputados de contrabando de
+guerra.
+
+ARTICULO V.
+
+Para que no haya duda sobre cuales sean los objetos ó artículos llamados
+de contrabando de guerra, declarándose tales: 1.º cañones, morteros,
+obuses, pedreros, mosquetes, rifles, carabinas, fusiles, pistolas,
+picas, espadas, sables, lanzas, dardos, alabardas, granadas, cohetes,
+bombas, pólvora, mechas, balas y todas las otras cosas pertenecientes al
+uso de estas armas: 2.º escudos, capacetes, corazas, cotas de maya,
+fornituras, y ropa hecha de uniforme, y para uso militar: 3.º correaje
+de caballería, caballos, lomillos, sillas de montar y cualesquiera cosas
+pertenecientes á esta arma: 4.º y jeneralmente toda calidad de
+instrumentos, de hierro, acero, laton, y de cualquiera otros materiales
+manufacturados, preparados ó formados expresamente para hacer la guerra
+por mar ó por tierra.
+
+ARTICULO VI.
+
+En el mencionado estado de guerra entre alguna de las Altas Partes
+Contratantes y una tercera Potencia, ningun ciudadano de la otra,
+aceptará comision ó carta de marca para el fin de ayudar, ó cooperar
+hostilmente con su enemigo, so pena de ser tratado como pirata.
+
+ARTICULO VII.
+
+No serán admitidos en los puertos de la Confederacion Arjentina y en los
+de la República del Paraguay, piratas ó ladrones de mar, y los Gobiernos
+de ambos Estados se obligan á perseguirlos y aplicarles rigorosamente la
+ley, del mismo modo á sus cómplices, y á los ocultadores de bienes asi
+robados.
+
+Igualmente se obligan á la devolucion de buques y cargamentos, á sus
+legitimos dueños, ciudadanos de cualquiera de los dos Estados, ó á sus
+apoderados, ó respectívos ajentes consulares.
+
+ARTICULO VIII.
+
+Si desgraciadamente sobreviniese la guerra entre la Confederacion
+Arjentina y la República del Paraguay (lo que Dios no permita) las
+hostilidades no podrán empezar entre ambos paises sin prévia
+notificacion recíproca, seis meses antes de un rompimiento.
+
+ARTICULO IX.
+
+En el caso del anterior art. 8.º ó de cualquier desacuerdo quiebra de
+amistad, ó rompimiento entre las dos Altas Partes Contratantes, los
+ciudadanos de cada una de las mismas Altas Partes Contratantes,
+residentes en el territorio de la otra, podrán permanecer en él para
+arreglar sus negocios continuar en su comercio, ù ocupacion en el pleno
+goce de su libertad y propiedad, con tal que se porten pacíficamente.
+Sus bienes de cualquiera clase que sean, ya estén bajo su propia
+custodia, ya confiados á particulares, ó al Estado, no estarán sujetos á
+embargo, ó secuestro, ni á ninguna otra carga, ó exaccion, sino à
+aquellas que pueden gravitar sobre propiedades semejantes,
+pertenecientes á los ciudadanos nacionales. Pero en el caso de que su
+comportamiento de motivo de sospecha justificada, se les podrá hacer
+salir del pais, concediéndoseles tiempo suficiente para sus arreglos, y
+la facultad de llevar consigo sus bienes y propiedades, y de disponer de
+ellos por cualquier medio legal.
+
+ARTICULO X.
+
+Los Arjentinos en el Paraguay, y los Paraguayos en la Confederacion
+Arjentina serán perfectamente libres para manejar sus negocios por sí, ó
+por apoderado, contratar, comprar ó vender por mayor ó menor, ventilar,
+y defender sus derechos, en conformidad con las leyes del Pais de su
+residencia, y con la misma libertad y derecho que los ciudadanos
+naturales.
+
+ARTICULO XI.
+
+Se observará igualdad perfecta y recíproca por ambas Repúblicas en la
+mas ámplia proteccion y seguridad de la propiedad de los ciudadanos de
+uno y otro pais; y no podrán ser gravados en los derechos de importacion
+y exportacion, sobre las mercancías, en los de tonelaje, puerto y demas
+imposiciones establecidas, ó que se establecieren tanto sobre el
+comercio directo, como sobre la carga, depósito, importacion, ó
+exportacion en las costas de una y otra República, con imposiciones mas
+gravosas que las que pesasen sobre los ciudadanos naturales.
+
+ARTICULO XII.
+
+Los ciudadanos arjentinos en el Paraguay y los ciudadanos paraguayos en
+la Confederacion Arjentina, gozarán en los respectivos territorios del
+mas pleno derecho á la posesion y uso libre de los bienes que
+introduzcan ó adquieran por compra, y venta, permuta, testamento,
+donacion, ó de cualquier otro modo legal, en conformidad á las
+respectivas leyes vijentes.
+
+Los bienes adquiridos por herencia, ó legado, no serán gravados con
+otros, ó mas altos derechos que los que pagaren los nacionales en casos
+semejantes.
+
+ARTICULO XIII.
+
+Los Arjentinos residentes ó transeuntes en la República del Paraguay, y
+los Paraguayos residentes ó transeuntes en la Confederacion Arjentina,
+no podrán ser obligados á servicio personal en el ejército y armada ni
+en las milicias nacionales y estarán exentos de contribuciones de
+guerra, préstamos forzosos, alojamiento y requisiciones militares.
+
+ARTICULO XIV.
+
+Ninguna propiedad arjentina sea de la naturaleza que fuere, podrá ser
+detenida, ó embargada en la República del Paraguay para el servicio
+público, ni aun á causa de urjente necesidad, sin prévio ajuste con los
+propietarios, apoderados, ó consignatarios, tanto de los valores
+detenidos, como de la indemnizacion convencionada, para el resarcimiento
+de daños y perjuicios que aquellos sufriren, lo cual deberá constar en
+estipulacion escrita y legalmente autorizada; y ninguna propiedad
+paraguaya sea de la naturaleza que fuere podrá ser privada en la
+Confederacion Arjentina, de las garantías acordadas por el presente
+artículo á las propiedades arjentinas.
+
+ARTICULO XV.
+
+Ambas Altas Partes contratantes se comprometen à no emplear en el
+servicio militar de mar ó tierra á los desertores del ejército de la
+otra, y convienen en la extradiccion de los soldados y marineros de
+guerra desertores, cuando fueren reclamados por los cónsules ó
+vice-cónsules respectivos.
+
+ARTICULO XVI.
+
+En el caso de fallecimiento _ab intestato_ de algun ciudadano arjentino
+en territorio paraguayo, ó vice-versa, el Cónsul jeneral, Cónsul, ó
+Vice-Cónsul de su nacion intervendrá en el inventario, depósito, sellos
+y enagenacion de los bienes del finado, de mancomun con el albacea ó
+curador que el Gobierno nombre hasta la distribucion de los bienes entre
+los herederos lejítimos, ó entre sus acreedores.
+
+ARTICULO XVII.
+
+La navegacion de los rios Paraná, Paraguay y el Bermejo es completamente
+libre y comun para los buques mercantes, y de guerra, arjentinos y
+paraguayos, en conformidad á las disposiciones vijentes en ambas
+Repùblicas.
+
+ARTICULO XVIII.
+
+Ambas Altas Partes Contratantes repetarán mútuamente los reglamentos
+fluviales que establecieren para seguridad de los intereses fiscales en
+las riberas de sus respectivos dominios, no pudiendo trasbarse en manera
+alguna el libre curso de la navegacion y comercio legítimo, ni con
+imposicion de derechos de tránsito, con detenciones, rejistros, ó
+embargos, ú otros impedimentos, en perjuicio de los intereses
+comerciales.
+
+ARTICULO XIX.
+
+Los puertos, canales habilitados para el comercio extranjero, ó que se
+habilitaren por el Gobierno Paraguayo, quedan abiertos para todos los
+buques, cargamentos y efectos que naveguen bajo pabellon arjentino: los
+buques paraguayos gozarán de igual beneficio en los puertos y canales de
+la Confederacion Arjentina, habilitados ó que en adelante se habilitaren
+para el comercio extranjero.
+
+ARTICULO XX.
+
+Las Altas Partes Contratantes admiten como buques arjentinos, ó
+paraguayos, los que naveguen con pabellon de una y otra República, que
+fuesen patentados, mandados, y tripulados de conformidad con sus
+respectivas leyes.
+
+ARTICULO XXI.
+
+En caso de que una de las dos Altas Partes Contratantes estuviere en
+guerra con alguna tercera Potencia, los dos Estados aceptan el princípio
+de que la bandera neutral cubre las mercaderías, á excepcion de los
+artículos de contrabando de guerra, y de los oficiales y soldados en
+servicio del enemigo.
+
+Por la misma razon, la propiedad neutral bajo pabellon enemigo, será
+reputada como enemiga. Este principio no es aplicable á las Potencias
+que no lo reconozcan y observen.
+
+ARTICULO XXII.
+
+Se admitirán mútuamente ajentes consulares para la proteccion del
+comercio respectivo, quienes en el lugar de su residencia gozarán de las
+inmunidades que se otorgue á los de igual clase de la nacion mas
+favorecida. Los papeles y archivos serán inviolables.
+
+ARTICULO XXIII.
+
+Los Cónsules, y empleados en el consulado, estan exentos de todo
+servicio público, y de todo derecho, impuesto y contribucion eceptuando
+los que están obligados á pagar por su comercio, industria, y propiedad,
+y en lo demas quedarán sujetos á las leyes de los respectivos Estados.
+
+ARTICULO XXIV.
+
+Queda aplazado el arreglo de límites entre la Confederacion Arjentina, y
+la República del Paraguay.
+
+ARTICULO XXV.
+
+No obstante lo acordado en el artículo anterior se declara: que la Isla
+de Apipé en el Paraná pertenece á la Confederacion Arjentina, y la de
+Yasiretá al Paraguay.
+
+ARTICULO XXVI.
+
+Las Altas Partes Contratantes se comprometen á establecer y costear en
+sus respectivos territorios, uno ó mas correos terrestres mensuales que
+conduzcan la correspondencia pública y oficial de uno á otro Estado, en
+los dias y hasta el punto que se acordase por separado.
+
+ARTICULO XXVII.
+
+Los cartas y correspondencias que llevasen la nota de francas del lugar
+de donde partieren, jirarán libres de porte por los correos de cada
+país.
+
+ARTICULO XXVIII.
+
+Las cartas y correspondencias conducidas por los correos de una y otra
+de las altas Partes Contratantes, de tránsito para el extranjero, ó para
+diversos puntos de ambos Estados, serán encaminadas á su destino por los
+mismos conductos establecidos para la direccion de la correspondencia de
+la administracion de correos donde se recibieren.
+
+ARTICULO XXIX.
+
+Si las cartas ó correspondencias, á que se refiere el artículo anterior,
+para un país extranjero, ó para cualquier punto de uno de los Estados
+Contratantes no pudiesen seguir á su destino, sin prévio pago del porte,
+no será por esto detenido su curso. En este caso la administracion que
+la despachare anticipará el porte correspondiente, formando cargo de su
+valor á la administracion de donde procedieren, llevándose á este fin la
+cuenta respectiva, cuyo monto será liquidado cada seis meses, y pagado
+en la forma que acordaren ambos Gobiernos. La base de esta francatura
+será la tarifa en vigor en la administracion que interviniere en el
+despacho de la correspondencia. Con este motivo las tarifas se
+comunicarán mútuamente.
+
+ARTICULO XXX.
+
+La correspondencia oficial de los respectivos Gobiernos, y la de sus
+Ajentes Diplomáticos, los periódicos, publicaciones oficiales de uno y
+otro pais, panfletos, revistas, ú otros impresos destinados á la
+circulacion, circularán libres de porte por los correos de ambos paises.
+
+ARTICULO XXXI.
+
+El presente Tratado será ratificado competentemente y las ratificaciones
+canjeadas en la ciudad del Paraná, Capital Provisoria de la
+Confederacion Arjentina, dentro de tres meses ó antes si fuere posible.
+
+ARTICULO XXXII.
+
+La declaracion hecha en el art. 25 de este Tratado, es definitiva: todas
+las otras estipulaciones, salvo lo acordado en el art. 24, serán
+vijentes por seis años contados desde el canje de las ratificaciones.
+
+En fé de lo cual Nos los Plenipotenciarios de la Confederacion
+Arjentina, y de la Repùblica del Paraguay, en virtud de nuestros plenos
+poderes, firmamos por duplicado este Tratado, y le hicimos poner los
+sellos de las armas respectivas. Hecho en la ciudad de la Asuncion,
+Capital de la República del Paraguay, á los veinte y nueve días del mes
+de Julio del año del Señor de mil ochocientos cincuenta y seis.
+

+Y teniendo presente el mismo Tratado, cuyo tenor queda preinserto, y
+bien visto y considerado por Nos, y habiendo sido aprobado por el
+Congreso Lejislativo de la Confederacion Arjentina, por su ley soberana
+en 26 del corriente mes aceptamos, confirmamos y ratificamos dicho
+Tratado para ahora y para en adelante ofreciendo y prometiendo cumplirlo
+y hacerlo cumplir, asi en el todo como en cada una de sus
+estipulaciones, usando para el efecto de todo el poder y medios á
+nuestro alcance.
+
+En testimonio de lo cual firmamos el presente instrumento de
+ratificacion, sellado con el sello nacional y refrendado por el Ministro
+Secretario de Estado en el Departamento de Relaciones Exteriores, abajo
+firmado.
+
+Dado en el Palacio de Gobierno de la ciudad del Paraná, Capital
+Provisoria de la Confederacion, á los treinta dias del mes de Setiembre
+del año del Señor de mil ochocientos cincuenta y seis.

+Acta de canje de las ratificaciones del Tratado de
+Amistad, Comercio y Navegación, celebrado entre la Confederacion
+Arjentina y la República del Paraguay.
+
+A los seis dias del mes de Noviembre del año del Nacimiento de Nuestro
+Señor Jesucristo, de mil ochocientos cincuenta y seis, Su Excelencia el
+Sr. Dr. D. Salvador María del Carril, Vice-Presidente de la
+Confederacion Arjentina, en ejercicio del Poder Ejecutivo, acompañado de
+su Ministro Secretario de Estado en el Departamento de Relaciones
+Exteriores, recibió en audiencia particular al ciudadano Paraguayo D.
+Felix Egusquiza, Comisionado por el Gobierno de aquella República á fin
+de proceder al canje de las ratificaciones del Tratado de Amistad,
+Comercio y Navegacion concluido y firmado en la Ciudad Asuncion, por los
+Plenipotenciarios de ambos países, á veinte y nueve de Julio del
+presente año, y siendo presentados los instrumentos orijinales de dichas
+ratificaciones, fueron inmediatamente canjeados.
+
+En fé de lo cual el Dr. D. Bernabé Lopez, Ministro Secretario de Estado
+en el Departamento de Relaciones Exteriores de la Confederacion
+Arjentina, y D. Felix Egusquiza, Comisionado del Gobierno de la
+República del Paraguay, debidamente autorizados por sus Gobiernos,
+firmaron la presente acta y la sellaron con sus sellos particulares.
+
+Fecha por duplicado en la Ciudad del Paraná, Capital Provisoria de la
+Confederacion Arjentina, hoy en el mismo dia y año arriba mencionados.
